1. Your relationship with Codestunts
These Terms of Service (“Terms”) govern your access or use from within the countries, it’s territories and possessions that Codestunts (“Codestunts Inc. and subsidiaries”) available. PLEASE READ THESE TERMS CAREFULLY, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND CODESTUNTS. By accessing or using the Services (“Clearly described in section 3”), you confirm your agreement to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. Codestunts may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.
2. Platform and member roles
Codestunts connects the Employers (“Customer, Project owner”) with Freelancers (“Vendor, Service Provider ”) within it’s competitive bidding platform and offers a set of collaboration tools to track progress status and ensure the services of the freelancers have been received properly. Codestunts is NOT a party between Employer and Freelancer and has no any kind of control on them.
3. Services that made available to you
The term “Services” covers the function of Codestunts that includes competitive bidding, communication, collaboration, transaction management platform. Responsibilities of the Codestunts limited to keeping the reputation records of each member, management of the job requests to ensure the listing quality, guidance for payments and solving disagreements between parties. In order to use most aspects of the Services, you must register for and maintain an active personal user Services account (“Account”). You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an Account, unless a specific Service permits otherwise. Account registration requires you to submit to Codestunts certain personal information, such as your name, address, mobile phone number and age (“requirements may differ for service providers”), as well as at least one valid payment method supported by Codestunts. You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access or use the Services. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times.
4. Use of platform content
Codestunts made available for information technology (“IT”) service providers that offering software development, design, consultation, installation and buyers who interested with those services. You agree to not provide content (“Job listings, attachments, membership information, profile pictures”) that including defamatory, libelous, hateful, violent, obscene, pornographic, unlawful, or otherwise offensive and does not relate with information technology market. Opposite behaviour might cause limitation of the account permissions.
5. Ways to access Codestunts
Platform designed to use by human beings, you agree to will not use any kind of automation software that called robot, spider or scraper without permission of the site operators. To prevent fraud and exchange of false information Codestunts requires you to connect from IP address that issued by your own internet service provider. An opposite behaviour such as use of international public proxies, anonymity networks or any other virtual circuits might resulted as failed payments or withdrawals.
6. Billing and Payment
Vendors of the Codestunts signing contracts directly with the employer (“buyer, client”) for those services offered by them. As stated in section 2, Codestunts will not be a party to any contracts for tasks or services. Payment for services through the Codestunts platform is made directly from the Employer to the Freelancer and not by Codestunts Inc. If an Employer fails to pay a Freelancer for services provided through the Codestunts platform, Codestunts Inc. may in it’s sole discretion, pay the freelancer for such services but Codestunts Inc. is not obligated to do so. Not with standing the foregoing, Codestunts Inc. is not obligated to pay freelancer for employer’s failure to pay for services. Payment processing services for Freelancers on Codestunts are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”) By agreeing the terms of service or continuing to operate as a service provider on Codestunts, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of Codestunts enabling payment processing services through Stripe, you agree to provide Codestunts accurate and complete information about you and your business, and you authorize Codestunts to share it and transaction information related to your use of the payment processing services provided by Stripe.
7. Refunds and Cancellations
Buyers eligible to cancel a project and get a full refund (exceptions apply) within next 24 hours after handshake, on situations like vendor fails to deliver service, platform unavailability or platform related technical errors.
8. External links and third party services
Codestunts may contain links to third-party websites. Platform may also contain applications that allow you to access third-party websites via the Codestunts. Such third-party websites are owned and operated by the third parties and/or their licensors. Your access and use of third-party websites, including online communication services, such as chat, email, and calls will be governed by the terms and policies of the applicable third-party websites. You acknowledge and agree that Codestunts is not responsible or liable for availability or accuracy of third-party websites or the content, advertising, or products on or available from third-party websites. You are responsible for deciding if you want to access third-party websites by clicking on a link or installing an application. The inclusion of any link or application on the Site does not imply that we endorse the linked site or application. You use the links and third-party websites at your own risk and agree that your use of an application or third-party website via the Platform is on an “as is” and “as available” basis without any warranty for any purpose. Codestunts is only responsible for the contents of domain “codestunts.com” and it’s subdomains. Also Codestunts cannot guarantee the site content on situations like insecure connections, use of deprecated web browsers or operating systems.
